Messaging Opt-In Policy (SMS / MMS / Group MMS)

This page describes how ZibbyAI, Inc. ("Zibby," "we," "us") obtains consent for SMS and MMS messaging, what messages we send, how often, how much they may cost, and how to opt out. It is the public Call-to-Action (CTA) and messaging disclosure for our customer-care messaging programs, including Group MMS and one-to-one (single person) threads with Zibby.

1. Who is messaging you
Messages are sent by ZibbyAI, Inc. (brand name: Zibby). We operate a two-way conversational customer-care messaging program over SMS and MMS. We do not send marketing or promotional advertising texts as part of this program.
2. Which phone numbers send messages
Because Zibby runs one shared messaging program across production and supporting service numbers, messages under this policy may come from any of the following Zibby-owned US numbers. The number that appears in your invite, group thread, or in-app Group MMS setup is the number you are opting into for that conversation.

We may add or replace service numbers for the same program. When we do, this page will be updated and, where required, we will provide notice or obtain fresh consent. We will not send program messages from numbers that are not disclosed here or shown to you at the point of opt-in in the Zibby app.
Important: You only receive messages after you opt in as described below. We do not buy contact lists or message people who have not invited Zibby into a thread or completed an in-app/web consent step.
3. What messages you will receive (use case)
This program is customer care / transactional messaging only. Message types include:
• Disclosure and onboarding: first message when Zibby is added to a group or one-to-one thread, including a claim code to link the conversation in the Zibby app where applicable.
• Command and support replies: responses when you message Zibby or use @Zibby commands (for example help, status, pause, resume, remember this, and similar control commands).
• Service and account notices related to the linked conversation or messaging feature (for example claim status, pause/resume confirmation, safety refusals, and operational notices).
• Optional media: if you send photos, video, or audio in an opted-in thread, we may receive them and reply with a confirmation or a short follow-up related to that capture.
We do not use this program for marketing blasts, promotional campaigns, or advertising offers. Memory suggestions in Group MMS remain off until a linked Zibby reviewer enables them in the app.
4. How you opt in (Call to Action) - Group OR single person
You can opt in on a multi-person Group MMS or in a one-to-one thread with Zibby only. Both paths are the same program and the same consent standard.
Path A - Group MMS or one-to-one thread with Zibby's number (primary)
• You open a US or Canada SMS/MMS conversation that is either (1) a multi-person Group MMS, or (2) a one-to-one thread with only you and Zibby.
• You voluntarily add or message Zibby's official number for this program. You may do this by adding the contact from the Zibby iOS app Group MMS setup / invite flow, or by adding/texting a published Zibby messaging number listed on this page.
• Adding Zibby to the thread, or sending a first message to Zibby on that number after choosing to contact Zibby, is your express written consent to receive program messages in that conversation while Zibby remains a participant (or until you opt out).
• Zibby sends a disclosure message explaining that Zibby can see messages while included in the thread, that memory suggestions stay off until a linked reviewer enables them (for group flows), and ”when applicable' a time-limited claim code.
• Where a claim code is provided, a Zibby account holder may claim/link the conversation in the authenticated Zibby mobile app. Claiming links the conversation to an account for review and control features; it does not replace the opt-in created by adding/messaging the number.
• After opt-in, Zibby sends transactional replies and required service/compliance messages only (for example responses to @Zibby help, status, pause, resume, and similar commands).
Path B - Optional in-app or website phone collection (if shown)
If Zibby displays a phone-number field in the iOS app (for example onboarding or Settings) or on a public web form at zibby.ai:
• You enter your mobile number yourself.
• You check an unchecked consent box (never pre-checked) next to clear disclosure language.
• The disclosure states that you agree to receive automated text messages from Zibby related to this messaging program (customer care / conversational memory support and account notices), that consent is not a condition of purchase, that message frequency may vary, that message and data rates may apply, that you can reply STOP to cancel or HELP for help, and that you can review this Opt-In Policy, the Privacy Policy, and the Terms.
• You submit / continue, and you may receive a confirmation message.
Consent is not a condition of purchase. You can use core Zibby features without enabling messaging.
What we record
Where technically available, we record the time of opt-in, the mechanism (group add, one-to-one message, in-app, or web), and conversation or account identifiers needed to honor STOP and operate the service. We retain records as needed to demonstrate consent and operate the program, then delete or de-identify per our Privacy Policy and retention rules.
5. Message frequency
Message frequency may vary. Volume depends on how often you (or other participants in a group you opted into) message Zibby, use @Zibby commands, and whether service notices are required. This is not a fixed daily marketing drip. Replies to messages you send are conversational and may occur whenever you initiate contact.
6. Cost
Message and data rates may apply. Zibby does not charge you a separate fee to receive these texts, but your mobile carrier's standard SMS/MMS and data rates may apply under your plan. MMS with photos, video, or audio may use additional data.
7. How to opt out
You can stop messages at any time by:
• Replying STOP to any program message (also recognized: STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT).
• Removing Zibby's number from a Group MMS or deleting/ending the one-to-one thread.
• Using in-app controls where available (for example pause/remove Group MMS features for a linked conversation).
• Emailing support@zibby.ai to request removal from messaging.
After a valid STOP, we send a single confirmation that you are unsubscribed and then stop further program messages to that number for this program, except as required to confirm the opt-out. You may reply START (or YES / UNSTOP where supported) to re-enable, or re-add Zibby to a thread / re-complete an in-app consent step.
8. How to get help
Reply HELP or INFO to any program message for help information. You can also email support@zibby.ai or use https://www.zibby.ai/contact-us. In Group MMS / bot threads, you may also use @Zibby help for in-thread command help.
9. Example messages (representative)
Examples of the kinds of messages you may receive (wording may vary slightly; not marketing):
Disclosure: "Hi, this is Zibby. I can see messages in this Group MMS while I'm included. Memory suggestions are off until a linked Zibby reviewer enables them. Claim this group in Zibby with code ABCD-1234-EFGH; it expires in 7 days. Reply @Zibby status or @Zibby pause anytime. Msg frequency may vary. Msg & data rates may apply. Reply STOP to cancel, HELP for help."
Help: "Zibby commands: status, pause, resume, remember this, and more. Msg frequency may vary. Msg & data rates may apply. Reply STOP to cancel, HELP for help."
Pause: "Zibby is paused for this group. I will not create suggestions or candidates until @Zibby resume or reviewer settings re-enable them. Reply STOP to cancel, HELP for help."
Opt-out confirmation: "You have been unsubscribed from Zibby messages from this number. You will not receive further messages unless you re-opt in. Reply START to resubscribe."
10. Privacy and data sharing

We do not sell mobile phone numbers. We do not share or sell SMS/MMS opt-in data or consent to third parties for their marketing or promotional purposes. We share numbers and message metadata only with service providers that help us deliver and operate messaging (for example our messaging platform and infrastructure providers), under contract, and only as needed to provide the service, comply with law, or secure the platform.
11. Eligibility and supported regions
You must be 18 or older (or the age of digital consent in your jurisdiction, if higher) and the account holder or authorized user of the mobile number used to opt in. This messaging program is intended for US and Canada mobile numbers for Group MMS / SMS program participation as supported by carriers. Delivery is not guaranteed; carriers are not liable for delayed or undelivered messages.

13. Changes
We may update this Messaging Opt-In Policy. Material changes will be posted on this page with a revised "Last updated" date. Where required by law or carrier rules, we will notify you and/or obtain fresh consent.
